There is a new ACA eFiling mandate that applies to all employers that offered a self-insured group health plan (including level-funded and ICHRA) in 2023. What you need to know:

All employers that sponsored a self-insured health plan (including level-funded and ICHRA) in 2023 have an obligation to file, regardless of size.

Filing must be done electronically by April 1, 2024.

Failing to file electronically triggers a penalty of $310 per form.

If you want to furnish forms to individuals electronically, you must get their permission.

If you had workers in any of the following states in 2023, you also have state reporting obligations: California, Rhode Island, New Jersey, Massachusetts, Vermont, or the District of Columbia.
